Personal Data Processing Policy
Data Controller and Data Subject
The controller is the company operating this website and the booking service.
A data subject is a natural person who has provided their personal data to the controller
under a lease agreement, purchase agreement, service agreement or any other agreement
entered into with the controller, or on the basis of consent to the processing of personal
data when subscribing to
newsletters from the controller. A data subject may also be a natural person whose personal
data were obtained by the controller from other lawful sources.
Scope of Data Processing
The controller processes personal data to the extent it was provided to the controller by
data subjects, or to the extent it was obtained by the controller from other lawful sources.
Personal data include: first name, surname, date of birth, address, place of business,
identification number, payment card number, tax identification number, email address,
telephone number and signature.
Purpose of Data Processing; General Consent
The controller processes the personal data of data subjects for the purpose of fulfilling a
contract entered into between the data subject and the controller, whether by means of
electronic communication remotely or in writing, to comply with legal obligations and for the
purposes of direct marketing (i.e. offering the controller's products and services), including
the sending of commercial communications within the meaning of Act No.
480/2004 Coll., on certain information society services. The controller sends commercial
communications only if the data subject has subscribed to newsletters and has given
separate consent to the processing of personal data for marketing purposes.
Purpose of Personal Data Processing; Consent for Marketing Purposes
The controller processes the personal data of data subjects for the purpose of fulfilling a
contract entered into between the data subject and the controller, whether by means of
electronic communication remotely or in writing, to comply with legal obligations, and for
the purposes of direct marketing, promotional offers, and information about the hotel and
its activities. Data subjects can easily unsubscribe from newsletters free of charge.
Assessment of the Necessity of Data Processing
The controller is committed to protecting the privacy of data subjects and therefore
processes only those personal data that are strictly necessary for the specified purposes of
processing.
Legal Basis for the Processing of Personal Data
The legal basis for processing carried out for the purposes of direct marketing is the data
subjects’ consent to the processing of personal data (subscription to newsletters) or
the controller's legitimate interest (obtaining an electronic contact in connection with the
sale of the controller's product or service in accordance with Act No. 480/2004 Coll.).
In other cases, the legal basis for processing is the performance of a contract, the protection
of the controller's legitimate interests (protection of property, the enforcement of
contractual rights in legal proceedings, etc.) and compliance with a legal obligation.
Data Processing Period
In the case of personal data processed for the purpose of fulfilling a contract, the controller
processes the personal data for the duration of the contractual relationship and
subsequently for a further 10 years,
having regard to the limitation period for claims for damages or injury. Where processing is
carried out to fulfil a legal obligation, the controller processes personal data for the period
provided by law. In the case of personal data processed on the basis of the data subject's
consent, the controller processes the personal data for a period of 10 years, unless consent
to the processing of the personal data is withdrawn earlier. This is without prejudice to the
controller's obligation to process personal data for the period specified by, or in accordance
with, the applicable laws.
Withdrawal of Consent to the Processing of Personal Data
If a data subject has given the controller consent to the processing of personal data, the data
subject may withdraw their voluntarily given consent to the processing of personal data at
any time, free of charge. The withdrawal of consent does not affect the lawfulness of
processing based on consent given prior to its withdrawal. Withdrawal of consent also does
not affect the processing of personal data which the controller processes on a legal basis
other than consent (i.e. in particular where the processing is necessary for the performance
of a contract, to comply with a legal obligation, or for other reasons provided
by the applicable laws).
Access to Personal Data
The controller and, where applicable, third parties – recipients – who provide appropriate
safeguards and whose processing complies with the requirements of the applicable laws
and ensures the proper protection of data subjects’ rights, have access to the personal
data of data subjects.
